I have a kohler bendix drive 12volt starter its brandnew it grabes flywheel but wont turn it thanks

Well... Did you buy it from Kohler? Did you give the folks you bought it from any good info??? Can you turn the flywheel by hand? Did you ask the folks you bought the new starter about this? We all need the model/spec numbers to even to be able to start to help.....

yes battery is good had it tested. not sure about gear. doing same thing as the old one

Sounds like you aren't getting enough amperage to the starter. Battery, Bad wires, poor connection, bad switch or solenoid. Now I m saying amperage not voltage.

Just for fun try using done jumper cables from the car battery to the mower battery.
Per carsw above if you have the old starter... Get a blue felt tip marker and color the drive gear teeth on both starters. Engage, remove each starter and compare. You could be jammed up if the new tooth count or profile is wrong.
whats the model# of the engine? its doin the same thing as the old one- did the old one ever work right? some more info on the history of the engine would be helpful.
