Why is so hard for people to understand that something is Sold As Is No Warranty? I fix up used mowers and resell. Some keep threatening with lawsuits and filing complaints on cause mower breaks down after they start using it. I check over and they run good. If aint broke I cant fix it.

Still at least they can't actually sue you...

I was told they could still sue unless both buyer and seller signs it.

Hmm I don't know about that but I just say now is sold as is seller is not responsible for any additional repairs or damage caused by machine.

Try "Not intended for reuse, sold as is for parts only, no warrant implied or expressed"

If someone buys a used mower from you and brings it home to use and it breaks down, just why wouldn't you stand in back of the sale or fix it. I guess its something I just couldn't do. Yes I can see a time limit or if it was miss use. I guess that makes me a very poor business person.

When I repair and resale I stand behind my work. If it breaks because they hit a rock that's not my problem. If it breaks, or doesn't work right because of something I did wrong I eat it and repair. In the 4 years I have been doing this full-time there's been less than a handful of people that have had issues. I take care of it right away. In order to get new business you have to take care of your old business!! Word of mouth is very important. I thoroughly go through all equipment I repair and sell. I load test run and tune so people don't have issues. Does it take more time?? Yes. I would rather do it right the first time.

If your customer took there used mower home and mowed for 10 min and the engine locked up do to know fault of there's. I would do whatever it takes to make it right......... Yes it cost you!! Yes its an inconvenience!! Part of the reason why people buy from small engine repair people is they want a machine that works right!! If you have more equipment with problems, and customer complaints than happy customers. It might be time to look into the way you repair your equipment. You can't guarantee the life of a used mower...... But you can make sure it runs, and works to its very best and all maintenance is performed while you have it.

I do not warranty my used equipment because i sell cheaper to get of them not to get rich. Pushmowers start $40 and Riders start @ $400. Another reason is I dont know if PO take care of the equipment or abused it.

Would you like it if someone sold you something that was no good for any amount of money? Like I said I guess it makes a me a poor business person because I couldn't do it unless they p### me off.

Thats why its sold cheaper cause its sold as is. There other shops in my area that do the same. Used car lots do the same also in the area.

In New York used car lots can't sell cars like that. They must pass a NYS inspection. . Like I said I am very poor at doing business and that is the reason I have always worked for someone else. Just the different between you and me, seeing I would feel sorry for them. Also about the time someone said they were going to sue me is the time I wouldn't do anything for them because then I am P##### off at them.

Regarding selling used equipment. I can't guaranty it won't blow up next day. I don't expect a seller to guaranty anything either.
That's the chance you take with used equipment.
For repairs that sentence in italics covers it. Because people can be stupid. I wouldn't patch something up just long enough to get paid. I fix it the way I'd want it fixed if it were mine. But once that machine leaves your possession you have no control over what the owner does to or with it.
Also if something needs extensive work and the owner doesn't pay for it to be fixed correctly then he is on his own.
If I fixed something and the repair didn't last because I screwed up it's a different story.

I sell a lot of mowers like I said with my recipts no warranty as is. But if they come back a day or two later saying its not working ill take a few mins to see what I can do. If they come back a month later I tell them no.... Or if I fix something for someone (which I usually don't I just exchange mowers don't hold onto someone else's property) if I did something and they bring it back saying whatever I just fixed is broke again ill look at it. Can usually tell who's fault it is

Yeah you take them on a case by case basis. Some people want a lifetime warranty!! If they call me a week after they bought the mower I will look at it. If they call me 6 months after I will still look at it............ They will pay for the repairs though....... If they run garbage fuel through it and it won't start that's not your fault. If they didn't check the oil and a year later locked the engine up its not covered. If they bought it a day before and it won't start I will make a house call. I understand the asis warranty. Its just good customer service.

Well for me its just a hobby. I am in no way a repair shop that's why I typically don't hold onto other peoples machines to fix ill buy it from them and sell them a working one. But I also have a heart and depending on the situation ill either help or I won't

If I sell a mower rider/push, I won't sell it if I can't give a 30 day warranty. Like said before word of mouth goes a long way. If the buyer hits a rock, pipe, ect thats on them, but if I sell them a POS thats on me, I don't want that. I sell mowers as if my mother was the buyer. If I take care of the buyer, they tell their friends that I don't sell junk and their friends come to me and buy. Thats the same with service, I will not fix junk, junk is junk. Too much trouble trying to fix something that is too far gone. But that just me!

It doesent matter if anyone thinks that there is a good case for a lawsuit, they can/will sue, and you need to hire a lawyer to protect yourself....... No "cheesy" "disclaimer" will help anywhere.....

I've been sued before, anyone can sue you, but winning is different. I never got a lawyer for something I can handle. Facts are facts, the judge sees this.

 I've never been sued but this seems sensible. In some states the loser pays his court costs and yours. I'll repeat my MO on this... if I made a mistake I'll fix it because I screwed up and I should fix it. Thats as far as I go. All reasonable buyers/repair customers are going to respect that. Anybody else is just looking for some free service.

That last statement is so true! Theres some people out there that are looking for a free lunch. They think that if they threaten you with a lawsuit you will just roll over and pay or give them free service. I'm with you, if I screwed up I should and will fix it or make things right, but I'm not going to be used like a fool.

Because people are rude, crude, and looking to get one over on anyone they can. Sold "AS IS" is exactly what it says. I'm afraid you will have to man up and stand up for what you sold and what they bought. Just say no.

Thats what I have been doing by saying no. Its only couple people per year that try to ruin it.

I don't respond to BBB. I don't belong to BBB. I don't communicate with them. They harassed me to death a few years back and I told them if they didn't stop calling me I would contact the BBB, lol. They are a phony outfit.

Nah, this trend from internet type sales that the customer can get a full refund and backrub, so amazon, e-bay, etc.... follow suit.

Then the sites that give businesses a bad name if they don't advertise emerge, angie's list, home advisor, scum like that.

So sick of angies list I have an account there they call me once a week telling me I need to pay. I have had 0 views on that page in 3 years and they want me to pay?
