WE BOUGHT A NEW SEARS 100 SERIES 42 IN RIDING LAWNMOWER . STA 6/11/16 WAS MOWING THE LAWN . FINISHED UPPER YARD FIRST WITH NO ISSUES .
STARTED ON LOWER YARD .WHICH IS LONGER AND STEEPER IN GRADE . ON 4TH CIRCLE PASS , GOING DOWN HILL . THE MOWER WENT CRAZY AND SPED UP VERY QUICKLY AND VERY FAST . THIS IS AN AUTOMATIC . I TOOK MY FOOT COMPLETELY OFF THE PEDDLE THAT INGAGES DRIVE . IT THREW ME OFF . AND CONTINUE RUNNING , AND HIT SOME TREES ABOOUT 25 FEET AWAY . WHEN WIFE CAME AROUND THE HOUSE , SHE RAN OVER AND TURN IT OFF WITH KEY , EVEN THOUGH NOTHING WAS ON THE SEAT TO KEEP IT RUNNING . I SPENT THE NEXT 6 DAYS IN THE HOSPITAL IN ICU 3 BROKEN RIBS , COLLAPS LUNG AND TORN SHOULDER CUP ..I AM SCARED OF MY MOWER ...... IT ALMOST KILLED ME . WHAT SHOULD I DO ? IM 65 YEARS OLD

Do you know how steep the slope was? The manual says anything over ~15degrees is too steep. That said, if you have the model with the Forward/Neutral/Reverse lever and foot pedal speed control, the mower should have at least slowed down when you released the pedal, and the motor should have stopped when you fell off the seat. Since neither of those things happened, I would think you either have a defective machine, OR something came loose (safety switch?), OR something was modified (again, safety switch).

Ring customer service at Sears.
The mower is under warranttee and sounds like it has been tampered with or has defective parts.
Be nice but make sure they know the mower accident had you hospitalised.
Sears stand behind everything they sell and have an excellent after sales service.
Be nice, be polite and ask for some one to come out and check over the mower because you think it might be defective.
They are standing in the barrels of a law suit so should be even more co-operative.
What ever you do, do not put a spannar on the machine.
Something could have jambed the vri- drive at full speed and the wiring to the safety switches could have dropped off in transit.
While both of these are by themselves very rare occuruences having the two happening at the same time is about the same as winning the lottery.

While I am not one for engaging in law suits, I would be having a chat to one of the compensation lawerers.
While the slope may have been too steep and there may have been some contributory negligence on your part if nothing else you should get a new mower properly serviced .
Do not uder any circumstances put a spannar on the mower as it is now evidence.
After you have talked to the lawer ( attorney over there ? ) take his advice.

Sears are good people and they stand behind everything they sell.

If you don't want to get the law involved then ring Sears and tell them what happened.
Tell them you have sought technical advice and have been led to believe the mower is defective and may have caused the accident.

Sears will send some one out to look a the mower & your yard, but I would strongly advise talking to a legal person first if for no other reason that you will then know exactly where you stand.

Just remember , if you end up seeking compensation, once the mower is out of your hands it is no longer evidence.
So if you would be happy with a new mower I am sure Sears will be more than happy to replace it with a new one.

The grade is less then 10% . I had my foot completely off the right side foot lever yet it was flying . I know sears would love to replace the mower , only problem is , like you say , I then have no evidence . My medical bills are already over 60K and climbing , and being on medicare . I have a co-pay yet to be determond . with more medical bills yet to come .I am so lost on what to do and scared to have anyone use the lawnmower and get hurt with me knowing something is wrong .

I cannot find a new 1100 sears lawntractor. I also do not understand how you got thrown off the unit when you disengaged the foot pedal when you already had the foot pedal disengaged . Also. does this mower have a brake/ If so why did you not brake as it was going at runaway speed? What is the model and serial number on this unit? It sounds like a MTD.
