Cub Cadet model 1042

Have a Cub Cadet with 18 hours on it. Parked it, next time I started it the rear wheels are locked up. It's a model 1042, any ideas?

Parking brake is stuck. It is a small lever either sticking up, or hanging down on the side of the tranny. Usually located on the right side in front of the axle. May need a little pull, or push to free it up.
